REFUND_POLICY
1. PROJECT DEPOSITS
A non-refundable deposit of 40% is required to initiate any project with swiftlogicforge. This deposit secures your position in our development queue and covers initial planning, architecture design, and resource allocation.
2. MILESTONE PAYMENTS
Remaining payments are tied to project milestones. Refund eligibility for milestone payments is assessed based on the work completed at the time of cancellation:
- Before work begins: 100% refund of milestone payment (excluding deposit).
- Work in progress: Pro-rata refund based on percentage of completion.
- Milestone delivered: No refund for completed milestones.
3. SUBSCRIPTION SERVICES
Monthly subscription services (hosting, maintenance, support retainers) can be cancelled at any time with 30 days written notice. Refunds for prepaid months are calculated on a pro-rata basis.
4. REFUND PROCESS
To request a refund, contact [email protected] with your project reference and reason for the refund request. Refunds are processed within 14 business days to the original payment method.
5. EXCEPTIONS
Refunds are not available for: third-party licenses or subscriptions purchased on your behalf, domain name registrations, custom design work that has been approved and delivered, or work completed under time-and-materials agreements.
TERMS_OF_SERVICE
1. ACCEPTANCE OF TERMS
By accessing or using the services provided by swiftlogicforge, located at 14 Cours de l'Intendance, 33000 Bordeaux, France, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. SERVICES SCOPE
swiftlogicforge provides web development, technical consulting, and digital product engineering services. The scope of each project is defined in a separate Statement of Work (SOW) or proposal document agreed upon by both parties.
3. PAYMENT TERMS
- Invoices are payable within 14 days of issue unless otherwise agreed.
- Late payments incur a 1.5% monthly interest charge.
- Work may be suspended if payment is overdue by more than 30 days.
- All prices are in Euros (EUR) exclusive of applicable taxes.
4. INTELLECTUAL PROPERTY
Upon full payment, all intellectual property rights for custom-developed work are transferred to the client. swiftlogicforge retains the right to display completed work in portfolios and case studies unless a non-disclosure agreement is in place.
5. CONFIDENTIALITY
Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 24 months.
6. LIMITATION OF LIABILITY
swiftlogicforge's total liability shall not exceed the total amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
7. GOVERNING LAW
These terms are governed by French law. Any disputes shall be resolved in the courts of Bordeaux, France, unless otherwise agreed in writing.
